2. Data We Collect

• Account data: Email address, encrypted password (via Supabase Auth)
• Usage data: Folders, track metadata (title, artist, BPM, etc.)
• Audio files: Music files you upload (stored on Cloudflare R2, EU region)
• Technical data: IP address, browser type (server logs for security purposes, auto-deleted after 30 days)

3. Purpose & Legal Basis

• Contract performance (Art. 6(1)(b) GDPR): Providing the VeloCloud service, storing and syncing your music library
• Legitimate interest (Art. 6(1)(f) GDPR): Service security, abuse prevention, and technical stability

4. Third-Party Processors

All processors are bound by GDPR-compliant data processing agreements. Data transfers to providers with US headquarters are secured by Standard Contractual Clauses (SCC).

5. Storage Duration

Your data is stored as long as your account exists. Upon account deletion, all personal data and uploaded files are permanently removed within 30 days.

6. Your Rights

You have the right to: access, rectify, delete, restrict processing, data portability, and object to processing. Contact us at mail.veloplayer@gmail.com.

You may lodge a complaint with the Bavarian Data Protection Authority (BayLDA).

7. Cookies & LocalStorage

VeloCloud uses only technically essential cookies/localStorage for authentication and session management. No marketing tracking, no analytics, no third-party cookies.

Terms of Service

1. Service

VeloCloud is a personal cloud storage service for music files, provided by Homm & Kasper GbR. The VELO Player app and VeloCloud web portal allow users to upload, organize, and stream their personal music library for private, non-commercial use only.

2. Accounts

You must provide a valid email address. You are responsible for maintaining the security of your account credentials. Sharing accounts is not permitted.

3. Acceptable Use & Copyright

• You may only upload audio files that you own or have the legal right to use.
• You may not upload copyrighted material for the purpose of illegal distribution.
• VeloCloud is a private storage tool; any public broadcasting or file-sharing is prohibited.
• You are solely responsible for the content uploaded to your account.

4. Storage & Subscriptions

Pro subscribers receive up to 8 GB of cloud storage. Subscriptions are handled via Apple's App Store (StoreKit). Pricing and cancellations are governed by Apple's terms.

Right of Withdrawal: For digital content, you agree that your 14-day right of withdrawal expires once you start using the cloud storage service.

5. Account Deletion

You may delete your account at any time. Upon deletion, all your data, including uploaded files, will be permanently removed within 30 days.

6. Limitation of Liability

VeloCloud is provided "as is". We do not guarantee 100% availability.

We are liable for damages caused by intent or gross negligence. For slight negligence, we are only liable if essential contractual obligations (cardinal obligations) are breached.

Data Loss: We are not liable for the loss of data if it could have been prevented by regular backups. Users are strongly encouraged to keep local backups of their files.

7. Changes

We may update these terms with reasonable notice. Continued use of the service constitutes acceptance.

8. Governing Law

These terms are governed by German law. If you are a consumer, mandatory statutory rights of your country of residence remain unaffected. Place of jurisdiction is Nürnberg, Germany.
